Catalina Foothills HOA BOD Meeting, September 12, 2006

BOD Attendees: Jenna Cohen, Raymond Graap, Dante Archangeli and Jim Wezelman
This meeting did not count as an official Board of Directors meeting because we did not have at least 5 members present to create a quorum. So no decisions were made only discussion.

1. Minutes approved via email for the July BOD meeting.
2. Treasurer's Report: Dante presented the August report and is working to complete the annual financial audit.
3. Old Business:
a. CC&R's recommended changes for annual dues and special assessments: Our attorney has recommended that we bring our CCandRs up to modern standards, which would allow that annual dues be determined by the BOD, depending upon the actual annual operating budget and the appropriate reserve requirements. This information would be presented to the HOA at the annual meeting, along with the financial report. The idea is to change the current need for a 2/3rd majority vote of the association to a majority vote of attendees at a meeting of the association.
b. Roads update: The roads are being repaved on the 21st and 22nd and subsequently the speed humps will be installed on Camino Miraval
c. Proposed new garbage service: Current ideas are to change the service completely to a local company with smaller and lighter trucks (or) to provide this service to the private roads and continue the WM service to those on the county roads (or) to continue WM. This is currently being researched to determine the availability and cost. This will be discussed at the annual Nov. meeting.
d. Live at Home: Janise was not in attendance and so no report on this issue

4. New Business
a. Fire District: Idea to get rid of Rural Metro. No one is in favor of this idea
b. Fireworks: County ordinance that fireworks are not legal
c. Catalina Foothills Association Representative: Jenna Cohen has potentially volunteered for this depending on the number of meetings and hours required
d. BOD for 2007: The annual meeting will be November 6 and we will begin to solicit homeowners to run for a BOD position for 2007. ALL BOD members must re-run for their position, there is only a one year term for each member, although it has been tradition that members serve for 3 years.
e. Arizona State HOA Laws:
i. Late fees: Can only assess up to a 10% late fee
ii. Solar Panels: They allowed; the HOA can have reasonable restrictions re the use and placement.
iii. Political Signs: have to be a reasonable size and are allowed for up to 45 days before and election and 7 days after an election
iv. Proxy voting is prohibited but mail (actual US Postal Service, not email) is allowed as well as absentee ballots.
v. HB2824, HOA / Homeowner dispute law and hearing right: Homeowners have a right to a hearing to settle a dispute with their HOA
